This agreement was written in Indonesian. To the extent any translated version of this agreement conflicts with the Indonesian version, the Indonesian version controls.
These Terms of Service (“Terms”) govern your access to and use of, as a registered user and/or as a non-registered user, the services as a member of Arena, as a general user, event organiser, moderator, and/or guest show in Arena, includes (without limitation) our various websites, short messaging services (“SMS”), application programming interfaces (“APIs”), various mobile operating systems, email notifications, applications, buttons, widgets, including information statistics/data/reports and/or other user’s response (the “Services”), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms. We expressly reserve the right to change these Terms from time to time without notice to you. You acknowledge and agree that it is your responsibility to review the Services and these Terms from time to time and to familiarize yourself with any modifications. Your continued use of the Services after such modifications will constitute acknowledgement of the modified Terms and agreement to abide and be bound by the modified Terms. As used in these Terms references to “Us” and/or “We” and/or “Arena” and/or “Infrastructure Provider” include our parents, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, licensors, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering the Services and/or its contents. As used in these Terms references to “You” include as a registered user and/or as a non-registered user. If you are accepting these Terms and using the Services on behalf of a company, brand, institution, organization, government, and/or other legal entity, you represent and warrant that you are authorized to do so, and everything related to your usage are the responsibility of your company, brand, institution, organization, government, and/or other legal entity that you represent.
You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other registered and/or non-registered users of the Services and through third party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms. The Services that Arena provides are always evolving and the form and nature of the Services that Arena provides may change from time to time without prior notice to you. In addition, Arena may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you. The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by Arena on the Services are subject to change. In consideration for Arena granting you access to and use of the Services, you agree that Arena and any of its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. Services by the system is a limited/closed network provided by the Infrastructure Provider, and therefore each user that uses the Services is automatically a member of the limited/closed network or network.
In order to access some of the Services, you will be required to use an account and password that can be obtained by completing our online registration form, which requests certain information and data (“Registration Data”), and maintaining and updating your Registration Data as required. By registering, you agree that all information provided in the Registration Data is true and accurate and that you will maintain and update this information as required in order to keeping it current, complete, and accurate. Failure to do so shall constitute a breach of the Terms, which may result in immediate termination of your account. You may not (i) select or use as an account a name of another person with the intent to impersonate that person; (ii) select or use and account that is similar to another person/institution (iii) use as an account a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as an account a name that is otherwise offensive, vulgar or obscene. Arena reserves the right to refuse registration of, cancel an account, make available a cancelled account to another party in its discretion. Arena reserves the right to cancel an account that is inactive for 3 months, so that such account is made available to be registered/used/utilised by other party/user. You also grant us the right to disclose to third parties certain Registration Data.Any information that you provide to Arena is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information for storage, processing and use by Arena. As part of providing you the Services, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, which you may not be able to opt-out from receiving.You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Arena cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
All Content, whether publicly posted or privately transmitted, as a general user, event organiser, moderator, and/or guest show in Arena, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorses any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will Arena be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.You retain your rights to any Content you submit, post or display on or through the Services. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). You agree that this license includes the right for Arena to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals who partner with Arena for the syndication, broadcast, distribution or publication of such Content on other media and services, subject to our terms and conditions for such Content use.Such additional uses by Arena, or other companies, organizations or individuals who partner with Arena, may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.You are responsible for your use of the Services, for any Content you provide, and for any consequences thereof, including the use of your Content by other users and our third party partners. You understand that your Content may be syndicated, broadcast, distributed, or published by our partners and if you do not have the right to submit Content for such use, it may subject you to liability. Arena will not be responsible or liable for any use of your Content by Arena in accordance with these Terms. You represent and warrant that you have all the rights; power and authority necessary to grant the rights granted herein to any Content that you submit.
We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Services, to suspend or terminate users, and to reclaim usernames and/or accounts without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Arena, its users and the public.You may not do any of the following while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Services, the Arena’s computer systems, or the technical delivery systems of Arena’s providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Arena (and only pursuant to those terms and conditions); (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.Your use of the Services is subject to all applicable laws and regulations, and you are solely responsible for the substance of Content through the Services. By posting information in or otherwise using any communications service, channel, chat room, or other interactive service that may be available to you on or through the Services, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content, including (without limitation) text, communications, software, images, sounds, data, or other information, that (i) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates the Terms; (ii) victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; (iii) infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party; (iv) constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling; (v) contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; and/or (vi) impersonates any person or entity, including any of our employees or representatives (“Objectionable Content”).We neither endorse nor assume any liability for the contents of any material uploaded or submitted by registered and non-registered users of the Services. Users are enabled to flag or report Content that they consider as Objectionable Content. We will review the flag or reports by users regarding Objectionable Content, at a best effort basis within 24 hours and determine whether such Content considered as Objectionable Content or not based on our sole discretion. We do not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through the Services. However, we have the right at our sole discretion to remove any Content that, in our judgment, does not comply with these Terms, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such Objectionable Content. You hereby consent to such removal and waive any claim against us arising out of such removal of Objectionable Content.We are not responsible for the settlement of any disputes that certain Content posted on the Services infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party. This is the resposibility of the relevant users. We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, Sebansa will also terminate a user’s account if the user is determined to be a repeat infringer.In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Not all areas of the Services may be available to you or other authorized users of the Services. You shall not interfere with anyone else’s use and enjoyment of the Services. Users who violate systems or network security may incur criminal or civil liability. You agree that we may at any time, and at our sole discretion, terminate your membership, account, or other affiliation with our Services without prior notice to you for violating any of the above provisions. In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.
We need your help to keep Arena safe, which includes the following commitments by you:

We respect other people’s rights, and expect you to do the same.
This section limits the liability of the Infrastructure Provider and its parents, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, licensors, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering the Services and/or its contents (collectively, the “Infrastructure Provider Entities”).
You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the Services with or without notice and for any reason, including, without limitation, breach of these Terms. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon termination or suspension, regardless of the reasons therefore, your right to use the services available on the Services immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Services. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, warranty disclaimers, limitations of liability and indemnity.
No agency, partnership, joint venture, or employment is created as a result of the Terms and you do not have any authority of any kind to bind the Infrastructure Provider in any respect whatsoever. The failure of the Infrastructure Provider to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. The Terms is not assignable, transferable or sublicensable by you except with the Infrastructure Provider’s prior written consent. The Infrastructure Provider may transfer, assign or delegate the Terms and its rights and obligations without consent. The Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Indonesia. These Terms, and our Privacy Policy are the entire and exclusive agreement between the Infrastructure Provider and you regarding the Services (excluding any services for which you have a separate agreement with the Infrastructure Provider that is explicitly in addition or in place of these Terms), and these Terms supersede and replace any prior agreements between the Infrastructure Provider and you regarding the Services.
